Acceptance

By downloading or using Then & Now (“the App”), you agree to these Terms. If you don't agree, please don't use the App. They add to Apple's standard End User License Agreement.

The App

Then & Now is an iPhone app for taking, organising and comparing progress photos: albums, Ghost mode, the voice timer, the slider, side by side and timelapse views, measurements and Trends, exports, reminders and private albums. Your data is kept on your iPhone and, if iCloud Sync is on, in your own iCloud.

Free and Premium

Every feature is free, with up to 99 new photos a week. Exports from the free version carry a small “Then & Now App” logo. Premium removes the weekly limit and the logo.

• Monthly Premium: $4.99 a month, renews monthly.
• Annual Premium: $29.99 a year, renews yearly. New subscribers may get a 7-day free trial; the Premium screen shows whether you can.
• Lifetime Premium: $99.99, paid once.

Prices are in US dollars; the App Store shows the price in your country and currency.

Subscriptions and renewal

• Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends.
• Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
• Your account is charged for the renewal within 24 hours before the period ends, at the plan's current price.
• Manage or cancel any time in the Settings app: tap your name, then Subscriptions. Deleting the App doesn't cancel a subscription.
• Any unused part of a free trial ends when you buy a subscription.
• Restore a purchase with “Restore” on the App's Premium screen, and redeem a code with “Redeem” on the same screen.
• Refunds are handled by Apple under its own policies.

Family Sharing

Premium can be shared with your Family Sharing group. Each person's photos, albums and measurements stay on their own iPhone and in their own iCloud.

Your content

You own everything you create in the App. Mahalo Mochi doesn't receive, access or claim any rights to your photos or data.

Our app

The App, including its design, code, graphics and icons, belongs to Mahalo Mochi LLC and is protected by intellectual property laws. You may not copy, modify, distribute or reverse-engineer it.

Limitation of liability

The App is provided “as is”, without warranties of any kind. To the extent the law allows, Mahalo Mochi LLC isn't liable for any indirect, incidental, special, consequential or punitive damages from your use of the App, including loss of photos or data. Keep a backup: leave iCloud Sync on, or export your photos to your camera roll from More → “Backup”.

Stopping

You can stop using the App at any time. Deleting it removes what's on your iPhone; to remove the iCloud copy, open the Settings app, tap your name, then iCloud, manage your storage and delete Then & Now's data. Cancel subscriptions in your Apple Account settings.

Apple

These Terms are between you and Mahalo Mochi LLC, not Apple. Mahalo Mochi LLC, not Apple, is responsible for the App and its content.

Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you as a third-party beneficiary.

Changes

We may update these Terms. Changes are posted here with a new date, and using the App afterwards means you accept them.
